1. About us & acceptance
LIV ASTA PRIVATE LIMITED ("Livasta", "we", "us", "our") operates an online marketplace (website and app) that connects guests with property hosts for short-term stays. By accessing or using Livasta, creating an account, listing a property, or making a booking, you agree to these Terms & Conditions ("Terms") and to our Privacy Policy and Refund & Cancellation Policy, which form part of these Terms. If you do not agree, please do not use the platform.
2. Eligibility
You must be at least 18 years old and legally able to enter into a contract. Guests and hosts must complete the required identity/KYC verification before booking or hosting. You are responsible for keeping your account credentials secure and for all activity under your account.
3. Role of Livasta (marketplace / intermediary)
Livasta is an intermediary/marketplace only. The accommodation contract is directly between the guest and the host. Livasta facilitates discovery, communication, booking, and payment collection, but is not the owner, operator, or provider of any listed property and is not a party to the stay itself. Hosts are solely responsible for their listings, pricing, availability, and the condition and legality of their properties.
4. Accounts & verification (KYC)
- Guests and hosts may be required to submit government-issued ID and other details for identity verification before transacting.
- You must provide accurate, current, and complete information.
- We may suspend or terminate accounts that provide false information, violate these Terms, or misuse the platform.
5. Bookings & payments
- All prices are shown in Indian Rupees (INR). The full amount payable is displayed at checkout before you pay.
- Payments are processed securely through our payment partner, Razorpay. Livasta does not store your full card details.
- A booking is confirmed only after payment is successfully authorized/captured. You will receive an in-app and email confirmation.
- You agree to pay the total shown at checkout, including the nightly rate, any cleaning fee, and the Livasta service fee.
6. Host hosting plans & service fees
- Hosts pay service fees to Livasta on the basis of their selected hosting plan, as displayed prior to plan selection or upgrade.
- Booking service fees (if applicable) are determined in accordance with the host's active plan; the remaining balance represents the host payout, settled per Livasta's payout schedule.
- Host plan terms, billing cycles, and cancellation provisions are set forth on the plan selection screen and in the Refund & Cancellation Policy.
7. Cancellations & refunds
Cancellations and refunds are governed by the Refund & Cancellation Policy, which forms part of these Terms. The cancellation policy applicable to a booking is the one displayed on the listing at the time of booking.
8. User conduct
You agree not to:
- provide false, misleading, or fraudulent information;
- use the platform for any unlawful, harmful, or abusive purpose;
- circumvent Livasta to transact off-platform to avoid fees;
- infringe others' rights or post unlawful content;
- attempt to disrupt, hack, or reverse-engineer the platform.
9. Host obligations
Hosts represent that they have the legal right to list and let their property, that listings are accurate, and that they comply with all applicable laws, permits, taxes, and safety requirements. Hosts are responsible for honoring confirmed bookings.
10. Liability & disclaimers
- The platform is provided on an "as is" and "as available" basis.
- Livasta is not liable for the acts or omissions of hosts or guests, or for the condition, safety, or legality of any property.
- To the maximum extent permitted by law, Livasta's total liability arising out of or relating to the platform is limited to the total Livasta fees you paid to us in the three (3) months preceding the event giving rise to the claim.
- Livasta is not liable for indirect, incidental, or consequential damages.
11. Indemnity
You agree to indemnify and hold Livasta harmless from claims, losses, and expenses arising from your use of the platform, your listings or stays, or your breach of these Terms or applicable law.
12. Intellectual property
All platform content, branding, and software are owned by or licensed to Livasta and are protected by law. You may not copy, modify, or exploit them without our written permission.
13. Suspension & termination
We may suspend or terminate your access for breach of these Terms, fraud, or legal/safety reasons. You may close your account at any time; certain records may be retained as required by law.

15. Governing law & jurisdiction
These Terms are governed by the laws of India. Courts at New Delhi, India shall have exclusive jurisdiction, subject to applicable law.
16. Changes to these terms
We may update these Terms from time to time. Continued use of the platform after changes take effect constitutes acceptance.
